{"id":1292,"date":"2022-02-26T07:12:57","date_gmt":"2022-02-26T07:12:57","guid":{"rendered":"https:\/\/blogs.uji.es\/cidl\/?p=1292"},"modified":"2022-02-28T21:10:54","modified_gmt":"2022-02-28T21:10:54","slug":"s4-4-the-concept-of-linguistic-equality-in-canadian-constitutional-law-cutting-the-gordian-knot-between-quebecs-bill-101-and-the-canadian-charter-of-rights-and-freedoms","status":"publish","type":"post","link":"https:\/\/blogs.uji.es\/cidl\/s4-4-the-concept-of-linguistic-equality-in-canadian-constitutional-law-cutting-the-gordian-knot-between-quebecs-bill-101-and-the-canadian-charter-of-rights-and-freedoms\/","title":{"rendered":"The concept of linguistic equality in Canadian constitutional law: cutting the Gordian knot between Quebec\u2019s Bill 101 and the Canadian Charter of Rights and Freedoms"},"content":{"rendered":"\n<h2 class=\"wp-block-heading\">\u00c9rik Labelle Eastaugh<\/h2>\n\n\n\n<h3 class=\"wp-block-heading\">Panel: Linguistic equality and justice in the face federal diversity: A Canadian perspective<\/h3>\n\n\n\n<h4 class=\"wp-block-heading\">Chair: Karine McLaren<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">Since 1969, Canada has adopted an array of legal measures aiming to address various inequalities between Anglophones and Francophones.&nbsp;&nbsp;These measures have been adopted by a range of actors in a variety of different contexts, giving rise to apparent inconsistencies or conflicts between them.&nbsp;&nbsp;The most widely remarked-upon of these apparent conflicts have been those between Quebec\u2019s&nbsp;<em>Charter of the French Language&nbsp;<\/em>(Bill 101), a law whose purpose is to protect the right to use French in a variety of public and private settings, and the&nbsp;<em>Canadian Charter of Rights and Freedoms<\/em>, a constitutional bill of rights which contains standard civil and political rights as well as several&nbsp;<em>sui generis&nbsp;<\/em>language rights based on a principle of equality between English and French.&nbsp;&nbsp;These two instruments are often described as being \u2018fundamentally\u2019 incompatible, on the grounds that they instantiate radically different principles of language policy and linguistic justice.&nbsp;&nbsp;This supposed incompatibility is usually framed in binary terms, with proponents claiming that Bill 101 protects \u2018collective\u2019 rights, while the&nbsp;<em>Charter&nbsp;<\/em>protects only \u2018individual\u2019 rights, that Bill 101 adopts a \u2018territorial\u2019 approach, while the&nbsp;<em>Charter&nbsp;<\/em>rests on a \u2018personal\u2019 one, and\/or that Bill 101 represents an exercise in self-determination by the Qu\u00e9b\u00e9cois, while the&nbsp;<em>Charter&nbsp;<\/em>is a centralizing force that deprives them of their autonomy.&nbsp;However, this paper will argue that the degree of conflict between the two measures is in fact substantially overstated as it rests on a series of false dichotomies, and that both the&nbsp;<em>Charter&nbsp;<\/em>and Bill 101 can be seen as pursuing a common goal of \u2018advance[ing] the equality of status or use of English and French\u2019 as set out in s. 16(3) of the&nbsp;<em>Charter<\/em>.&nbsp;&nbsp;In doing so, the paper will offer a critical examination of the use (and misuse) of certain key concepts in the debates over linguistic justice, such as collective rights and territoriality.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n","protected":false},"excerpt":{"rendered":"<p>\u00c9rik Labelle Eastaugh Panel: Linguistic equality and justice in the face federal diversity: A Canadian perspective Chair: Karine McLaren Since 1969, Canada has adopted an array of legal measures aiming to address various inequalities between Anglophones and Francophones.&nbsp;&nbsp;These measures have &hellip; <a href=\"https:\/\/blogs.uji.es\/cidl\/s4-4-the-concept-of-linguistic-equality-in-canadian-constitutional-law-cutting-the-gordian-knot-between-quebecs-bill-101-and-the-canadian-charter-of-rights-and-freedoms\/\">Continue reading <span class=\"meta-nav\">&rarr;<\/span><\/a><\/p>\n","protected":false},"author":164,"featured_media":0,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"_monsterinsights_skip_tracking":false,"_monsterinsights_sitenote_active":false,"_monsterinsights_sitenote_note":"","_monsterinsights_sitenote_category":0,"footnotes":""},"categories":[84399,84300,65362],"tags":[84394],"class_list":["post-1292","post","type-post","status-publish","format-standard","hentry","category-canada","category-legal-frameworks","category-linguistic-rights","tag-session-4-4"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.7 -
